Subject: Aestar – What to Do If Offered A Quitclaim or Special Warranty Deed?

First, hire a title company to search and examine. The goal is to discover any encumbrances or title problems before you purchase the property. For example, you may find that your property is subject to an ally easement in favor of your neighbors that you must agree to the access to them. Second, buy title insurance to protect yourself from unknown or undocumented title risks to the title examination. Title insurance helps pay to correct the title problem or to compensate you if the problem cannot be corrected. Third, even if you get a General Warranty Deed, some language embedded in the contract could reduce the general warranties such as “subject to all matters of record”. You shall always have your attorney review your deed.
